Workmanship Guarantee

This Workmanship Guarantee (hereinafter referred to as the "Guarantee") made and entered into this 2024-10-31 by and between: the client/company (hereinafter referred to as "Client"); and Guardsman Heating & Plumbing Services (hereinafter referred to as "Contractor").

 

Coverage

Workmanship for the installation/work delivered by Guardsman Heating & Plumbing Services is herewith Guaranteed to be free from defects for a period of 1-year from the date of completion.

 

Terms and Conditions Guarantee is subject to the following:

• Contractor has been paid in full for the workmanship.

• This Warranty does not cover any damage to a person or property arising from the use of any of the products or materials furnished or any methods employed in connection with the work.

• This Warranty stands null and void if any modifications or changes are made to the products or materials used in connection with the work without the prior written consent of the Contractor, inclusive of subsequent works delivered by an alternative contractor.

• This Warranty shall only be valid on installation/work and does not cover parts, materials or products not installed by the Contractor.

·      If you are a Business and on completion of the Services you are not satisfied with the workmanship, you must provide us with written notice of the reason for this within 12 months of completion of the Services and must allow us, and our insurers, the opportunity to both inspect the Services supplied by us, and, if required, carry out remedial work as appropriate. If you fail to notify us of any defect in the workmanship or refuse to permit an inspection in, we will not be liable in respect of any defects in the Services.

 

·      Subject to the conditions set out a Workmanship Guarantee will be provided. The guarantee will not be valid if the work undertaken by us has been:

 

o   subject to any misuse or negligent treatment by you or a third party; or

o   repaired, modified, altered, adjusted or tampered with by any party other than us.

 

·      This guarantee is in addition to any manufacturer’s guarantee provided in respect of Goods supplied and used in the Services which shall be subject to its individual terms. If you are a Consumer, this guarantee does not affect your statutory rights.

 

·       We will not accept any liability whatsoever for any materials or products supplied by you including, but not limited to, the suitability of such materials or products for the Services.

 

 

Exclusions

The following causes/reasons are not covered under this Warranty:

·       Damage caused by negligence, intentional misuse, or failure to properly maintain the work.

·       Damage is caused by conditions beyond our control, such as, but not limited to, acts of God (floods, lightning, etc.), war, civil unrest, or governmental regulation.

·       Any changes or modifications to the work performed by anyone other than the Contractor's authorised representatives.

·       Damage caused due to racks, crazing, mold, mildew, or other fungi.

·       Failure of the site to be prepared in accordance with our specifications prior to commencing work. This can include but is not limited to, excavations not being properly backfilled and compacted, or the site not being adequately drained.

·       This warranty does not cover any costs associated with the removal and/or reinstallation of the work.

·      No guarantee will be provided in relation to the following circumstances:

o   In respect of blockages in waste or drainage systems;

o   Where the Services have not been directly undertaken by us;

o   Where payment in full has not been received;

o   Where Services were completed on your instruction but against our written or verbal advice;

o   Where the fault arises because you elected not to have Services recommended by us in writing or verbally undertaken; and

o    Where the Services have been performed on installations or appliances in poor condition and/or over 10 years old.

 

·      We cannot guarantee to clear blockages occurring in a frozen pipe or drain, and we will not be liable for any fractured or frozen pipes or for any damage to any property resulting directly from such fractured or frozen pipes, except where such damage is solely and directly caused by our defective workmanship in the provision of the Services.

 

 

 

Claims

o   All the claims under this Warranty must be submitted in writing within 10-days of the defect becoming apparent.

o   The claim should be accompanied by receipt and must include photographic evidence of the defect.

o   The Contractor must be given a reasonable opportunity to investigate all claims and to remedy any defects found. Subsequently, the Contractor reserves the right to inspect the work in question and determine, in its sole discretion, whether the workmanship is defective.

o   Client understands that failure to give timely notice as set out in this clause will void this
Warranty.

 

Resolution

·       Replacement products, if required, will be new and of the same type, quality, and function as the originals, unless otherwise mutually agreed.

 

·      We shall begin the provision of the Scheduled Services on or around the date communicated in any Estimate. Whilst we shall take reasonable care and skill when specifying the date for the commencement of the Services, this date is an estimate only.

 

·      Emergency Services may be carried out on a 24/7 basis. We shall carry out Scheduled Services in such hours between our normal working hours of 08:00 to 18:00 as we shall designate provided that, where agreed between you and us and/or in the case of Emergency Services, we may agree to perform the Services outside of working hours.

 

 

·      We do not give any guarantee as to how quickly the Services will be completed. With certain Services, for example but not limited to, either an electrical fault or a blocked pipe, it may be necessary for a number of tests to be carried out to identify the exact location of the fault and whilst these will be completed as soon as reasonably practicable by their nature it is not known which test, if any, will yield results.

 

 

Non-transferable

This guarantee is non-transferable and shall be void if the ownership of the property on which the work was performed is transferred to another party prior to the expiration of the guarantee period.
